1. General Information and scope of application

1.1 These General Terms and Conditions (GTC) apply to the use of the mediation platform [Name of Website] (hereinafter referred to as “Platform”), operated by [Name of the company/operator].

1.2 The platform mediates rental agreements between landlords and tenants of [property types, e.g., vacation rentals, commercial spaces, etc.]. The GTC govern the contractual relationship between the platform operator, the tenants, and the landlords.

1.3 By using the platform and booking a rental property, tenants and landlords accept these GTC.


2. Description of services
2.1 The platform provides a mediation service through which landlords can offer their properties and tenants can book them.

2.2 The platform operator itself is not a party to the rental agreement between the landlord and the tenant. The platform serves exclusively as an intermediary.

2.3 A service fee is charged for using the platform, which must be paid by both the tenant and the landlord (see section 7).


3. Registration and user account

3.1 Registration is required to use the platform. The user must be at least 18 years old and provide complete and truthful information.

3.2 The access credentials must be kept confidential and must not be shared with third parties.

3.3 The platform operator reserves the right to suspend or delete user accounts if there is suspicion of misuse or violation of the GTC.


4. Offer and conclusion of contract

4.1 Landlords can list their properties on the platform, with all information provided being truthful and complete.

4.2 A rental agreement is concluded exclusively between the landlord and the tenant. The platform acts solely as an intermediary and has no influence on the content of the rental agreement.


5. Payment Terms and Service Fees

5.1 The platform charges a service fee from both the landlord and the tenant for the mediation. The amount of the fees is visible in the price list on the platform and will be displayed during the booking process.

5.2 The service fee is due upon successful completion of the booking and must be paid by both the tenant and the landlord.

5.3 Payment is made through the payment methods offered on the platform. The platform may engage an external payment service provider.


6. Obligations of the Landlords

6.1 Landlords are obliged to provide accurate information about their rental properties and respond promptly to tenant inquiries.

6.2 Landlords are responsible for complying with all local regulations, especially tax laws and safety requirements.

6.3 The landlord must ensure that the rental property matches the description and is handed over in excellent condition.


7. Obligations of the Tenants

7.1 Tenants agree to treat the rental property with care and to promptly inform the landlord of any damages. 

7.2 The tenant must pay the agreed rent and the service fee on time. 


8. Limitation of Liability

8.1 The platform is not liable for the fulfillment of the rental contract between the landlord and the tenant. All contractual and legal claims must be resolved directly between the parties involved.

8.2 The platform operator is not liable for damages caused by incorrect information provided by the landlord or technical malfunctions. 


9. Rating System

9.1 After the completion of a rental agreement, tenants and landlords can submit a review through the platform. The reviews must be truthful. 

9.2 The platform reserves the right to remove reviews that violate the guidelines or applicable law.


10. Termination and Suspension of the Account

10.1 Users can cancel their membership in writing at any time.

10.2 The platform operator reserves the right to suspend user accounts in case of violations of these terms and conditions or suspicion of fraud. 


11. Data Protection

11.1 The processing of personal data is carried out in accordance with the platform’s privacy policy and applicable data protection laws.

12.1 The platform operator reserves the right to change these terms and conditions at any time. Changes will be communicated to users in a timely manner via email. 
12.2 If the user does not object to the changes within [30 days] after notification, the changes will be deemed accepted. 


13. Severability Clause

13.1 If any provisions of these terms and conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.


14. Applicable Law and Jurisdiction

14.1 The law of the Federal Republic of Austria applies.
 
14.2 The court of jurisdiction for all disputes arising from this contractual relationship is, to the extent permitted by law, [location of the platform operator].
